Korean businessman avoids deportation over technicality

JUSTICE Secretary Alfredo Benjamin Caguioa has ordered the immediate release of Korean businessman Kang Tae Sik.

The Bureau of Immigration’s Board of Commissioners (BOC) ordered the deportation of Kang on the basis of his previous conviction for violation of the Bouncing Checks Law a few years ago.

Kang was meted 10 months imprisonment only, and the same was considered cumulatively served.

In a Nov. 6 order by Caguioa, BI was ordered to desist from executing the appealed BOC resolutions and to recall the Warrant of Deportation issued last Oct. 20, 2015 against Kang.

Caguioa explained that under the rules, “warrant of deportation shall only be prepared and issued by the Commissioner upon finality of a deportation order judgment or resolution.”

He said considering that there is still an appeal before his office, the resolution ordering his deportation has not become final and executory.

“Considering the foregoing and in the interest of justice, the Bureau is hereby ordered to desist from executing the appealed BOC resolution to recall the warrant of deportation against Mr. Kang Tae Sik and immediately release Mr. Kang from detention,” Caguioa’s memo stated.
