A Filipino accused of molesting his roommate’s daughter has been cleared by the Court of First Instance.

According to the Khaleej Times, the basis of the decision had yet to be determined. The ruling is subject to appeal by the prosecution.

The man, 37, allegedly groped the 12-year-old in their shared apartment while she was asleep.

The mother and daughter reported the case to the Bur Dubai police station. They said that he arrived home drunk accompanied by friends.

The mother, 45, left the girl while she was asleep at 1 a.m. She stated that she was working in the kitchen until 3 a.m.

According to the daughter, she woke up at 3:30 and felt the defendant groping her and touching her back. It was at this time when the flat owner entered the room to check on the girl upon the mother’s request; she thought the girl might have been alone after the man’s friends had left.

The flat owner was reported to have pushed the man away from the room.  Niña V. Guno /ra
