China alarmed by Clinton’s comments on West Philippine Sea

China has expressed concern about remarks made by US Secretary of State Hillary Clinton who said that Beijing’s claim in the West Philippine Sea (South China Sea) exceeded what was permitted by the United Nations Convention on the Law of the Sea (Unclos).

In a report posted Monday on its website, the Chinese Embassy in Makati City quoted Hong Lei, spokesperson of the Chinese foreign ministry, as saying that China had raised concerns about Clinton’s opinion when other countries had chosen to adopt a hands-off policy on the issue.

“On the issue of the South China Sea, nonclaimant (Association of South East Asian Nations) countries and countries outside the region have adopted a position of not getting involved in territorial disputes,” Hong said.

“On this important prerequisite and foundation, the Chinese side has consistently committed to safeguarding peace and stability in the South China Sea, region by means, such as negotiating and signing with Asean countries the Declaration on the Conduct of Parties in the South China Sea in parallel with our efforts to pursue dispute settlement through negotiations with countries directly concerned,” she said.

Two Democratic senators—John Kerry and Barbara Boxer—also criticized China’s claim in  the West Philippine Sea at last week’s hearing of the US Senate committee on foreign relations.

Illegal claims

Kerry, the panel chair, said “China and other countries are staking out illegal claims to the South China Sea and elsewhere.”

Boxer produced a map that  showed that China’s claims exceeded far beyond its 200-nautical mile exclusive economic zone provided for in Unclos and amounted to a “significant territorial grab that comes very close to the land borders of countries in the region.”

China, which is among the 160-plus nations that are party to Unclos that was concluded in 1982 and has been in force since 1994, has made expansive claims in the West Philippine Sea based mainly on ancient maps.

A map that China submitted to the UN in 2009 virtually claimed the entire West Philippine Sea. However, it failed to clarify the exact extent of its claims that overlap those of Taiwan, Malaysia, Vietnam, Brunei Darussalam and the Philippines.

According to the Chinese embassy, Hong also expressed concern about Manila’s supposed attempts to involve third parties in its conflict with Beijing over the Panatag (Scarborough)  Shoal also Bajo de Masinloc  to the Philippines and Huangyan Island to China.

“Attempts by the Philippine side to draw a third party into interfering or intervening through whatever means in Huangyan Island will surely escalate the situation and meet with firm opposition from the Chinese side,” Hong said.

Provocative actions

She also claimed that “the Philippine side has taken some provocative actions recently in the Huangyan Island waters, and the Chinese side has correspondingly strengthened management and control measures.”

“It was learned that the Huangyan Island waters is now stable on the whole. About 20 Chinese fishing boats are working in that area and the number is basically the same with that in the same period of previous years. The so-called around 100 boats are mostly one-person dinghies from the fishing boats,” she said.

Hong pointed out the operations of these fishing boats are  in line with related Chinese laws and China’s fishing moratorium.

“China’s public service ships are exercising strict supervision over these fishing boats to prevent any law-breaching operation,” she said.

Foreign Secretary Albert del Rosario expressed confidence that the Philippines could settle the Panatag Shoal dispute with China, as well as other West Philippine Sea-related issues, citing what he called the Department of Foreign Affairs’ comprehensive “overall plan.”

Del Rosario pointed out that the Chinese were “in violation of the Asean Declaration on the Code of Conduct in the South China Sea when they are preventing us from enforcing our laws in our EEZ.”

According to the DFA head, they had “broken up the overall plan into diplomatic or political, legal and defense tracks.”

Political track

For the political track, he said the country would continue to push for the transformation of the West Philippine Sea into a zone of peace, freedom, friendship and cooperation, where Manila would observe a rules-based approach to all disputes in accordance with Unclos.

For the legal track, the DFA plans to continue coordinating with other government agencies concerned as it resorts to a dispute settlement mechanism under Unclos.

For the defense track, Del Rosario said the foreign office had committed to help improve national defense by building a minimum credible defense posture to protect the country’s territorial integrity.

Del Rosario told the Philippine Daily Inquirer that aside from the United States, at least three other countries—Japan, South Korea and Australia—were also helping the Philippines establish that defense posture.

    1) The UNCLOS supersedes all historic claims, rendering China’s useless.
    2) Scaraboruough Shoal is hundreds of miles outside of China’s 200-NM EEZ. Meanwhile, the shoal is just located within 123 miles of the Philippines.
    3) The maps being relied upon by China not only show Scarboruough Shoal, but also the Philippines, Vietnam and other nations.
    4) WikiLeaks managed to publicize a cable showing that China cannot back its historic claims.

      UNCLOS’s principle is to claim water based on land. UNCLOS doesn’t support claim land based on water. Philippine’s logic is to claim Huangyan island (land) based on EEZ (water). It is groundless in UNCLOS.

    Let loose of that..We again and again should reduce imports from CHINA.  Our immigration Department should be very strict now.  We don’t need them.  Our Island is good enough to keep us moving.. We got other friendly countries that respect our citizenry..why bother going there and spent..also here overseas ..most of the goods are made in China but look on to where it came from originally…it came from us..Honkong put made in honking on clothing’s and where on earth did you find a plantation of cotton in Hongkong?….

    Philippines can survive this temporary vacuum that China occupies in our business but let’s do what is best…those who imports things from china should be given a higher tariff and duties so we can have money to buy ammunitions and etc..guarding our territories…

    How many of these chinese businessman are smugglers? Have several wives and can not explain their wealth, uses our women to circumvent their status of stay in our islands? Open your eyes kabayans and see them in Divisoria/Baclaran in the province.. Most of them have now chain stores involve in hardwares etc…some made it to manufacturing drugs and selling drugs…

    That’s the reason why we have to change our judiciary system.. chinese convicted of doing something can easily get out of Jail….WHY?

    Start applying the law with no exemptions in Chinatown, in Divisoria, and in stores owned by Chinese entrepreneurs on top of all stores in the Philippines. It is a known fact that smuggled goods are sold in these places and that Chinese businessmen would cheat any which way they can to avoid paying taxes.

    What are those countries “who had chosen to adopt a hands-off policy” in this news report? The Philippines is not among them and I don’t hear any other Asean adopting such policy either.
    Scarborough Shoal was quiet & peaceful when there was no presence of Chinese ships there. It will be 100% peaceful there again if China ships leaves the Scarborough Shoal right now. China can come back if the ITLOS decides it belongs to them. I myself will accept the ruling if it says so.China has no authority as well to dictate the Philippines from seeking help from the United States. The Philippines has a binding agreement with US that it will protect the country if it is attacked. The world knows and have seen America protects people from authoritarian.

        It is not a tank. It is a ship. Actually it was a former US coast guard cutter.

        It is their job to to find out what the foreign boats were doing there. It just so happened that those boats were chinese fishing boats caught poaching from our EEZ.

        The navy has the authority to stop this illegal foreign activity.

        If you think it is your territorial sea, why not use policy ship instead of flag warship?

        Philippine’s claim for Huangyan island is groundless.
        1.       Philippine’s territory has been well defined at Treaty of Paris and Huangyan island is not belong Philippine
        2. Unclos is used to claim water based on land. It doens’t support to claim land (Huangyan island) based on water (EEZ). No one is the world, except Philippine to claim land based on water. Taiwan island is in Philippine’s EEZ. Will Philippine exercises exclusive sovereign rights over Taiwan? Philippine is also in Taiwan’s EEZ, is Phillippine part of Taiwan?
         
        3. Unclos is use to solve the water issue. It doesn’t handle any territory, i.e. land, issue. So ITCLOS won’t take any territorial issue. The current Huangyan island dispute is territorial issue. That’s why Philppine precident still doesn’t file case to ITLOS as he commited almost 1.5 month ago.

        Below is UNCLOS’s related article for an island. Huangyan rock is a naturally formed area of land, surrounded by water, which is above water at high tide. So it is an island.

        Is that clear? Please also ask your goverment read UNCLOS at first before mis-use it. It is just a joke.

        Rocks which cannot sustain human habitation or economic life of their own shall have no exclusive economic zone or continental shelf.

        China has no objection with this provision. They know when this matter presented in ITLOS. Their 9 dash line map absurdity has no merit.

        Do you know according to UNCLOS article 6, un-habitable island entitle 12NM territorial seas? So huangyan island has 12NM territorial seas. Why do Philippine claim that just because it is in its EEZ?

    to prevent further animosity over some rocks in the middle of the sea near the philippines territory, i suggest to just bomb those rocks/shoal (around panatag shoal) to make it disappear, even during low tides……. then nobody can claim a shoal or an island……. then the 200 mile EEZ come into play
