MANILA, Philippines — The camp of dismissed Bamban mayor Alice Guo has filed a motion to dismiss the quo warranto petition filed by the Office of the Solicitor General (OSG) against her.

This was confirmed by Solicitor General Menardo Guevarra on Tuesday.

“Her counsel filed a motion to dismiss the QW petition last month. The OSG immediately filed its comment/opposition. The motion was heard on Aug 30. for resolution by the court,” he said.

A quo warranto petition is a legal action against a person who “usurps, intrudes into, or unlawfully holds or exercises a public office, position or franchise.”

Last July 29, the OSG filed a quo warranto petition against Guo before the Manila Regional Trial Court.

According to the petition, Guo is “usurping or unlawfully holding the position” of the mayor of Bamban town in Tarlac province and “illegally exercising” its duties and responsibilities.

She is under investigation for her alleged involvement in the illegal activities of a Philippine Offshore Gaming Operator (Pogo) hub in Bamban.

Questions about Guo’s citizenship were also raised during a Senate inquiry after Sen. Risa Hontiveros bared that Guo’s birth was registered only in 2013, or 17 years after she was supposedly born in 1986.

The National Bureau of Investigation later found out that the dismissed Bamban mayor and Chinese national Guo Hua Ping are the same person, bringing scrutiny into her eligibility to run for public office in the 2022 polls.
