The Department of Foreign Affairs (DFA) on Tuesday welcomed the Supreme Court’s decision to uphold the legality of the Enhanced Defense Cooperation Agreement (Edca) between the Philippines and the United States.
In a statement, the DFA said the controversial military agreement was a “critical component” in boosting the country’s national defense.
“We welcome the Supreme Court’s decision that affirms the constitutionality of the Edca,” the department said. “The Edca is a critical component of our efforts to enhance and strengthen national security and improve our humanitarian assistance and disaster relief capabilities.”

“With the Supreme Court’s decision, the Philippine and US governments can now proceed in finalizing the arrangements for its full implementation,” it added.
In a 10-4 vote, the high court on Tuesday ruled that the Edca was an executive agreement and not a treaty.
The Edca was signed in time for the state visit of US President Barack Obama on April 28, 2014. Petitioners have argued that several provision of the agreement was unconstitutional, including the ban on foreign military bases and facilities without Senate concurrence.
