SACRAMENTO, California – A care home company agreed to pay more than $39,000 in minimum wage and overtime back wages to 10 caregivers working at four separate facilities in the Sacramento area.
An investigation by the department’s Wage and Hour Division found that Ed David Care Homes Inc. violated the Fair Labor Standards Act’s minimum wage, overtime and record-keeping provisions.
The company paid its workers less than the federal minimum wage, currently $7.25 per hour, and failed to pay the required overtime premium for hours worked beyond 40 in a week in some workweeks.
Investigators found that the company paid some of its employees a flat day rate and/or a fixed number of hours per shift for all hours worked, regardless of the hours they actually worked, and deducted more than eight hours of sleep time for shifts of 24 hours or more which is prohibited by the FLSA. In addition, the employer failed to maintain accurate records of hours worked.
“Caregivers working long hours for those in need deserve a fair day’s pay for a fair day’s work” said Cesar Avila, the division’s assistant district director in Sacramento. “It is our goal to ensure that employees are paid for all hours worked and not illegally denied their wages.”
