SC won’t intervene in Ecleo case

First Posted 06:14:00 10/30/2009

THE Supreme Court (SC) will not intervene in the decision of Judge Soliver Peras to inhibit himself from the seven-year old parricide case of cult leader Ruben Ecleo Jr.

Deputy Court Administrator Nimfa Vilches, a classmate of Peras at the Ateneo de Manila, said inhibition is a judicial action which depends on the judge's sound discretion.

She said she could only take note of Peras? decision but the judge would have a final say on the issue.

?He (Peras) is the best person to know how hearings will be conducted,? said Vilches.

If Peras stands by his decision, Vilches said the case has to be re-raffled.

Vilches said that if no Cebu judge would want to handle the case, one of the parties may move for a transfer of trial venue.

She said while Peras has the authority to institute security measures inside his courtroom, he and the media would have to iron out their differences.

Last Monday, Peras said he would no longer handle the Ecleo case following a dispute with the media regarding his requirement which mandates reporters to submit photos to his clerk.

The prosecution and defense counsels have manifested their desire to ask Peras to reconsider his decision.
