CEBU City Mayor Tomas Osmeña arrives today from the United States to resume his duties and deal with two controversies: his son?s alleged bullying of a young woman and the fate of the restobar where Miguel?s girlfriend got drunk.
According to protocol officer Nagiel Bañacia, the mayor's official sick leave filed before his trip is until Sept. 30 and his presence today means he will assume immediately as mayor.
Banacia said he has no advice from the mayor about going on an ?indefinite leave?.
The mayor earlier said he would wait for the family of Samantha Benitez to file a complaint so his son Miguel could answer allegations of harassment aired in the media. But the girl?s family said they only want a private apology.
The College of Law of the University of San Carlos wrote to the City Legal Office requesting it to close down all nearby establishments that were proven to sell liquor.
USC Law dean Alex Monteclar said the noise generated by the live bands playing at Bakak Resto Bar has been disrupting classes.
The Bakak Resto Bar is being recommended for closure for operating without proper permits.
?It's my recommendation (to the owner) that pending the reply of my office, Bakak should and must on their own volition close their establishment for the meantime,? City Legal Officer Joseph Bernaldez said.
The move came after Richard Aznar, the registered owner of Bakak Resto Bar admitted that they don't have a business permit or liquor permit in the absence of an occupancy permit from the Office of the Building Official (OBO).
Aznar denied that the establishment serves liquor to minors . He said the restobar will comply with all requirements of the city so they won't be closed down.
Acting Cebu City Mayor Michael Rama said the Bakak Resto Bar should only serve liquor an hour after the end of the last class in accordance with the city's liquor ordinance.
The bar is located within the 100 meter radius of the nearest school, which is USC. .
Rama said if the last class ends at 9 pm, they should not serve or sell liquor before 10 pm.
He said the prohibition should not zero in on the Bakak restobar but all restaurants and bars that fall within the 100 meter radius of the schools, hospitals and public parks.
Bernaldez and Assistant City Treasurer Tessie Camarillo said the sale and serving of liquor should be prohibited in areas near universities and colleges to avoid drunken incidents involving students.
She said it would be difficult to monitor establishments selling near prohibited areas due to the time variance.
The mayor?s son Miguel had just started classes at the University of California Los Angeles.
Miguel was pointed to as the main suspect behind threatening text messages sent to Benitez, whom he was angry at for leaving his girlfriend Bea Villegas at the Bakak Resto Bar, where she got drunk and passed out.
Benitez who stepped out to eat with relatives said she later went home and found her digital camera hanging on the gate, destroyed with what looked like a bullet hole.
Miguel hasn?t directly responded, but his father, the mayor, denied his involvement.
