Maps show Rosalina Village belongs to two barangays

TO which barangay does Cebu City's Rosalina Village belong?

A City Council map shows that the village is in barangay Guadalupe, said Secretary Jose Marie Poblete, documents custodian of the City Council.

But Poblete, who testified at a court hearing yesterday, said residents of Rosalina Village pay taxes to barangay Labangon since the City Assessor's or Tax Map puts the village in Labangon.

A third map from the Commission on Elections (Comelec) shows that some residents of Rosalina Village voted in barangay Guadalupe while others, in Labangon.

The court yesterday conducted a hearing to find out which barangay has jurisdiction over Rosalina Village.

Labangon councilor Victor Buendia, a Rosalina Village resident, had asked the court to stop the Comelec from holding the plebiscite on whether or not to split barangay Guadalupe into two.

Buendia told the court that he would stand to lose his post if his place of residence would become part of the new barangay Banawa-Englis to be carved out of Guadalupe.

Buendia, a registered voter of barangay Labangon since 1993, said he could not participate in the plebiscite since he is not a registered voter of Guadalupe.

Last March 10, the court issued 20-day Temporary Restraining Order (TRO) against the plebiscite.

A ?cadastral? map from the Bureau of Land Management (BLM), does notclearly show where Rosalina Village lies.

The BLM under the Department of Environment and Natural Resources (DENR) is in charge of lands not under other government agencies.

James Fuentes, BLM geodetic engineer, said a map lost during the war would have shown where the village is. A 1951 reconstructed map does not.

Labangon barangay captain Felix Abella told the court that his barangay has jurisdiction over Rosalina Village and two other sitios as stated in a barangay resolution.

In a text message, Buendia?s lawyer Julius Caesar Entice affirmed the tax map.

?The cadastral map of the BLM would have settled the issue. But considering that it was lost during the war, the tax map will prevail,? Entice said.

But Rep. Antonio Cuenco of the city?s south district, plebiscite proponent , said Rosalina Village belongs to Guadalupe.

?The truth has slowly come out. The maps of the city council showed that Rosalina Village belongs to Banawa (a sitio of barangay Guadalupe). I don't have any doubt that the issue on geographical location of Rosalina Village will be resolved,? Cuenco said after the hearing.

Regional Trial Court Judge Gabriel Ingles of branch 58 scheduled the hearing on the preliminary injunction on Tuesday.
