1st gun ban violator in Cebu jailed

A Cebu City court has convicted a man for violating the 2010 election gun ban.

Regional Trial Court Judge Silvestre Maamo of branch 17 sentenced Argie Arceda to one to two years imprisonment for violating the gun ban imposed by the Commission on Elections during the election period.

Arceda is the first person to be convicted in Cebu since the gun ban took effect.

Maamo found sufficient reason to convict Arceda who admitted the crime charged against him. Arceda entered a guilty plea during his arraignment.

Arceda was also prohibited from holding office and exercising his right to suffrage.

Maamo also ordered that the firearm confiscated from Arceda be forfeited in favor of the government.

Arceda was arrested on Feb. 9 for carrying an unlicensed . 38 caliber revolver with no serial number and with four live bullets outside his house.

Arceda was charged with violating Comelec Resolution 8714 which states that during the election period? no person shall bear, carry or transport firearms or other deadly weapons in public places including all public buildings, streets, parks, and private vehicles or public conveyances, even if licensed to possess or carry the same.?
