Cebu City Hall seeking court aid in land disputes

THE Cebu City government will go to court in behalf of families living in areas affected by government entities which may have violated the Friar Lands Act and the Urban Development Housing Authority (UDHA).

The City Council authorized Mayor Tomas Osmeña to seek court action days after Cebu Gov. Gwendolyn Garcia reached another agreement with beneficiaries of Presidential Proclamation 409 in barangay Apas and assured that only a few of them would be dislocated.

During the closed door meeting with representatives of the Alliance of Barangay Apas Community Association (Abaca), Garcia said the PP409 was ?invalid.?

The PP 409 declares the area occupied by Abaca as a socialized housing site.

The land area the Apas families reside in forms part of the property donated by the provincial government to the Armed Forces of the Philippines (AFP) Central Command (Centcom).

While the lot was donated to the AFP as military reserve, CentCom used only a fraction of the land. Some 19 hectares have become home to a community of informal settlers.

The province then moved to recover the donated property.

Defense Secretary Gilberto Teodoro signed an agreement last month returning the lot to the province.

The CentCom will transfer to other locations outside Cebu City.

While the MOA didn't specify the eviction of residents living in the military reservation area, the families voiced anxiety that they would be relocated..

Garcia assured the Apas families that they would be transferred to a suitable relocation site.
