City measure sought on Architecture Law

A PROPOSED ordinance that seeks to impose penalties for violations of Republic Act 9266 or the Architecture Act of 2004 is under study at the Cebu City Council amid an ongoing dispute between architects and civil engineers over the law's implementation.

Councilor Nestor Archival said the ordinance will impose penalties from P3,000 to P5,000 for violation of RA 9266 which limits the preparations, signing and dry sealing of all plans, designs and documents related to building construction to licensed architects only.

Roldan Medeliano Jr., national president of the United Architects of the Philippines (UAP), said the law's implementation is hampered by their legal dispute with the civil engineers who insist that they are allowed to sign architectural plans based on RA 544 or the Civil Engineering Law.

Engr. Apollo Enriquez, chairman of the Board of Civil Engineering in the Professional Regulatory Commission (PRC) said RA 544 states that it is unlawful to order the construction, reconstruction, or alteration of any building unless the plans were signed by civil engineers.

City Councilor Gerardo Carillo said the council merely wanted to hear the sentiments of the two groups over RA 9266.

He said any questions about the legality of the Architecture Law are best resolved between the two groups.

Archival said they are taking into consideration the case filed by civil engineers and architects before a regional trial court in Manila.

Archival said he will call for an executive session to settle the issue between the two professions and use its output as basis for proper legislation.
