Court junks case against John-john O

THE court denied a motion for reconsideration filed by the Department of Justice (DOJ) on the case against former Cebu vice governor John Gregory Osmeña.

With this, the only son of former senator John H. Osmeña can consider the 2004 drug case, involving allegations that he had a role in the smuggled shipment of imported ingredients for shabu, over.

Cebu City Regional Trial Court Judge Eric Menchavez of Branch 21, in his Dec. 22, 2008 order, said he found no reason to reconsider the earlier order dismissing the charges.

He said all arguments raised in the motion merely repeated reasons in the memorandum which the court resolved.

The judge said “all the issues that need to be threshed out and resolved were all addressed and aptly discussed in the said order.”

“Justice has been done,” said lawyer Edgar Gica, defense counsel of Osmeña.

The lawyer said he considers the case closed and a vindication for John-john and his father.

The court ruled in November that the prosecution failed to establish evidence to link Osmeña to drug trafficking suspects Mike Cummings and Dirk Hultz.

Osmeña was accused of involvement in the smuggling of barrels of pseudo-ephedrine in Cebu in 2004.

On Dec. 9, 2008, the Department of Justice filed a motion for reconsideration on the court’s dismissal.

The DOJ panel of prosecutors asked the court to reconsider its decision, and issue a warrant of arrest against Osmeña for coddling and illegal protection illegal importers of pseudoephedrine. Correspondent Ador V. Mayol
