THE COURT has denied the motion for intervention filed by Crisologo Saavedra in the case filed by WT Construction Inc. (WTCI) against the Province of Cebu over P261 million in alleged unpaid bills for the Cebu International Convention Center (CICC).
“The court sees no compelling reason and necessity for a third person who is not even privy to the alleged contract, to make himself a party of this case,” said Regional Trial Court Judge Ester Veloso of Branch 6.
Veloso said Saavedra failed to establish any legal interest or any injury that he might suffer that would allow him to participate in the case.
Saavedra said that he would file a motion for reconsideration on Veloso’s decision.
Saavedra said his legal interest is as a taxpayer of Cebu.
He said that as a resident of Cebu, he is affected by how the Capitol awards the people’s money.
Earlier, in a comment on Saavedra’s motion for intervention, Capitol said Saavedra did not have legal interest in the case because he was not a resident of the province but of Cebu City, which is independent of the province.
But even if Saavedra lived somewhere in the province, Capitol said it was not reason enough for him to be able to intervene in the case as a representative of the people of Cebu.
WTCI, in their comment on Saavedra’s motion, also said they did not see how Saavedra could be directly affected by the company’s payment claims over the Province of Cebu.
The company said the case was merely about if the company should be paid for extra uncontracted works it did on the CICC.
