MCWD appointment ‘did not violate law’

A METRO Cebu Water District board member said there was no law violated in the appointment of Joel Mari Yu as a member of the MCWD board of directors.

Joy Augustus Young said that in the absence of a restraining order, Mayor Tomas Osmeña can name his choice of appointee to the water district's board.

“There is no order from the court (that stops Mayor Osmeña from appointing Yu). We are still on status quo so that means that the mayor can appoint.

“The MCWD board also approved the appointment because there was no restraining order. We went through the procedure,” he said.

According to Young, the Local Utilities and Water Administration questioned the board's failure to fill the position vacated by Adelino Sitoy three months before the May 2007 election. Sitoy was later elected mayor of Cordova town, Cebu.

Mayor Osmeña, who signed Yu's appointment papers on Feb. 22, said he added him to initiate a “major shakedown” in the management of the water district.

Yu already attended the board in last week's meeting, said Young.

The provincial government wanted to secure a copy of Yu's appointment papers and threatened to file a complaint for graft as well as seek for board members and Mayor Osmeña be cited in contempt of court.

Young said he would welcome the court case that the provincial government would file against the board members for approving Yu's appointment. Reporter Doris C. Bongcac
