Taiwan crewmen submit testimony in PH shooting probe

MANILA, Philippines — Three crewmen from a Taiwanese fishing boat that was fired upon by Philippine coastguards in an incident that sparked a diplomatic row submitted their sworn statements to prosecutors in Manila Monday.

The prosecutors are preparing homicide charges against eight coastguards over the shooting to death of 65-year-old crew member Hung Shih-cheng on May 9.

The charges were a key demand from Taipei as both sides move to mend bilateral ties.

The crewmen, two Taiwanese and an Indonesian, were accompanied by diplomats and interpreters as they submitted their statements.

The shooting occurred in waters near an island in the Philippines’ extreme north, which Taiwan also claims as part of its economic zone.

The coastguard had said the Taiwanese vessel was fishing illegally and they were forced to fire in self-defense as it tried to ram them.

But a video of the incident released last month has shown there was no attempt at ramming.

The Philippines and Taiwan began repairing a serious diplomatic rift after Philippine authorities recommended homicide charges in August.

That move was welcomed by the Taiwanese government, which reciprocated by lifting a ban on the hiring of new Filipino workers on the island.

Some 87,000 Filipinos work in Taiwan, according to official figures.

      Uh no, this case is a given because they killed a person without probable cause. I wouldn’t want a traffic enforcer to start shooting at cars that don’t follow traffic rules in the future, and failure to charge these PCG personnel with homicide would give that incident legal precedent.

        True. The rules of engagement should also be made clear for the PCGs. It is vague. The evasive maneuvers of the Taiwanese fishing boat falls into the hostile category according to their protocol. The “imminent threat’ should be made clear to avoid same mistake. Try crossing and running away from a remote police or military checkpoint next time and see the reaction, not just a normal traffic.. . . especially if thieves are reported in the area and in their case they shot and killed one of the thieves.

        At the heighten crossfire, whether it’s a pistol or high powered weapon on displayed, it’s the logic choice for enforcement officers on the scene to go for that eminent threat with counter measures. The prime response is to safe-guard his fellow men and territorial grounds of the nation. As I see it, this case should be closed, and no more than a penalty ( perhaps negligence), and a reasonable compensation paid to the victim’s family

        These “guys” were in Philippine territorial waters and were clearly warn of their “trespass”. Instead (according to initial reports) of heading the warning and heading into their line, those manning the vessels came to close for comfort. What will you do? When confronted with an “enemy” menacing towards you? Logic will say, scoot and run. But, the Coast Guards are to hold the ground. That’s the Maritime Law.         Okey. Assuming you are right. How many Philippine Islands do the Taiwanese fishermen have to pass to reach the Balintang channel? Ten? Twenty? Or Taiwan have to ask the Philippines government to remove some of the Philippine islands because it is inside the Taiwanese EEZ? I read the report but have you seen the map? Last week, the Filipinos caught a Taiwanese near an island much much nearer than where the shooting incident occurred? Why is Taiwan not saying now that it is in their EEZ? But then this is a different story. Sometimes these Filipinos also make stories, and their credibility is also questionable, at least for their leaders and government institutions.

    The best approach is that PH should go ahead without any delay to apply laws.
    At the same time, ask China privately for a pardon, or help to work with the families for a forgiveness.
